I believe you may have individuals more inclined to take you up on your offer.
It would be more than fair.
There is way too many uncertainties and issues outstanding with this registrar.
I moved my 140-plus domains away from them.
So glad I did.

Thanks mate, I am fully aware of the problems with registerfly, however I will not be transfering this domain. So it will be the new owner's resposablity if he/she chooses, I am willing to take an offer for this domain to offset the transfer fees
Where does your primary traffic come from? How long have you owned this domain and what page rank does it have?
